Rental Agreement

Please read this Agreement carefully before completing your rental request. By accepting delivery of the Equipment, you agree to all terms below. A signed copy is required before each rental shipment.

1. Parties

This Rental Agreement ("Agreement") is between Uplink WiFi ("Company," "we," "us") and the individual or entity named on the rental order ("Renter," "you"). By completing a rental request and accepting delivery of the equipment, you agree to be bound by this Agreement.

2. Equipment

The rental kit includes a Starlink Mini satellite dish with built-in WiFi router, rechargeable battery, AC wall charger, 12V vehicle power cable, Ethernet cable, rugged carry case, and quick-start guide (collectively, "Equipment"). The Equipment remains the sole property of Uplink WiFi at all times.

3. Rental Period and Fees

The rental period begins on the confirmed start date and ends on the confirmed return date. The daily rental rate is $75 per day, inclusive of the Starlink service plan and unlimited data. The rental period includes transit days for shipped rentals. Late returns are billed at the same daily rate until the Equipment is received by a FedEx or UPS carrier.

4. Damage Deposit

A refundable damage deposit is required before shipment or pickup. The deposit amount will be stated on your rental confirmation. The deposit is fully refunded when the Equipment is returned in the same condition it was received, with all components present. Uplink WiFi will assess any damage, missing items, or excessive wear against the deposit and notify you within 5 business days of return.

5. Permitted Use

The Equipment may be used for lawful purposes only within the 48 contiguous United States. You may not: (a) sublease, lend, or transfer the Equipment to any third party; (b) attempt to modify, tamper with, or reverse-engineer the Equipment or its software; (c) use the Equipment in violation of any applicable law or Starlink's terms of service; or (d) use the Equipment outside the continental United States without prior written consent.

6. Care and Responsibility

You are responsible for the Equipment from the time of delivery until it is received by a FedEx or UPS carrier for return. You agree to: (a) use the Equipment with reasonable care; (b) protect it from theft, loss, and avoidable damage; (c) return all components in the original carry case; and (d) not expose the Equipment to submersion in water or extreme conditions beyond its rated specifications.

7. Loss or Theft

If the Equipment is lost or stolen during your rental period, you must notify Uplink WiFi immediately by email or phone. You will be responsible for the replacement cost of the Equipment, which will be assessed against your deposit and invoiced for any remaining balance. Filing a police report may be required.

8. Return

A prepaid FedEx or UPS return label is included with every shipped rental. Pack all Equipment components in the original carry case and drop the package at a FedEx or UPS location by the last day of your rental period. For local pickup rentals, return the Equipment to the agreed location by the agreed time. Uplink WiFi is not responsible for Equipment lost in transit when the prepaid label is used.

9. Service and Connectivity

Uplink WiFi provides the Equipment with an active Starlink service plan. Internet connectivity is subject to Starlink's network availability, satellite coverage, weather conditions, and obstructions. Uplink WiFi makes no warranty regarding minimum speeds, uptime, or uninterrupted service. No refund or credit is issued for service interruptions caused by Starlink's network, weather, or your location.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UPLINK WIFI'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THIS AGREEMENT SHALL NOT EXCEED THE TOTAL RENTAL FEES PAID BY YOU FOR THE APPLICABLE RENTAL PERIOD. UPLINK WIFI IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE EQUIPMENT.

11. Indemnification

You agree to indemnify, defend, and hold harmless Uplink WiFi and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Equipment; (b) your violation of this Agreement; or (c) your violation of any applicable law or third-party right.

12. Governing Law

This Agreement is governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising from this Agreement shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

13. Entire Agreement

This Agreement, together with your rental confirmation and any applicable terms of service, constitutes the entire agreement between you and Uplink WiFi regarding the rental of Equipment. It supersedes all prior communications, representations, or agreements. Uplink WiFi may update this Agreement from time to time; the version in effect at the time of your rental confirmation governs your rental.
